We want to emphasize that you accept the terms of purchase by downloading and using the 'Swing by' app. We recommend printing out the terms of purchase and saving the document if you need it in the future. To have an account in the app, you must be 18 years or older. We reserve the right to delete accounts of individuals who have provided incorrect personal information.
These terms of use ('Terms of Use') are an integral part of the agreement ('Agreement') between Swing by AB, org. no. 559401-6676 ('Swing by') and you as a consumer when you enter into an agreement with Swing by for the provision of the digital service Swingby ('Service').
In the event of conflicting provisions in the Agreement, the terms of the main agreement shall take precedence over the General Conditions.
To access and use the Service, you must accept and comply with these Terms of Use. These Terms of Use apply to all visitors, users and others who have access to and/or use the Service.
SwingBy is a digital service within Sweden. Your account is set up by downloading the app through the Appstore or Google Play, where you choose a subscription. After starting your subscription, you are committed to monitoring your registered email address as all communication regarding your subscription will be done through email.
To ensure your security with your purchase, you are always welcome to contact Swing by's support and customer service through email at info@swingby.se if you have any questions about your order.
All prices are in Swedish Krona and include 25% VAT and other fees. When you shop in the app, the card payment is processed by Apple or Google, respectively. All card information is stored in accordance with the card network's regulations. No credit card data is stored in our database, even when you choose to save the card for future purchases.
The charge on your bank statement may show as swingby.se. Payment for monthly subscriptions is made every month, and annual subscriptions are made once per year. If payment is not made, login is blocked. When a subscription has been closed for 6 consecutive months, the subscription will be deleted and all information in your SwingBy subscription will be deleted from the database.
If you have entered into the Agreement with Swing by in the app, you have, according to the law (2005:59) on distance contracts and contracts outside business premises (“DAL”), the right of withdrawal. By exercising the right of withdrawal, you can terminate (withdraw from) the Agreement without giving any specific reasons.
To request a refund, we refer to the following options depending on where the purchase was made:
- Request a refund from Apple.
- Request a refund from Google.
To become a member and register a user account, you must be at least 18 years old and competent. If there is a suspicion that you are younger than 18 years old, we reserve the right to request verification of age for continued membership.
When you register as a member by creating a user account with us, you must provide truthful and correct information and ensure that you always keep your information up to date and correct. Failure to do so constitutes a violation of the terms, which may result in the termination of your user account and membership on our service. Swing by has the right to verify the provided information for continued use of the site, if there is a suspicion that the user profile has been created with false information. This includes being able to verify published photos that are believed to depict the person behind the profile.
You are responsible for protecting the password you use to access the Service and must under no circumstances reveal login information to anyone else. You also have a duty to notify us if your login information and/or your user account comes into the wrong hands.
Under no circumstances should you create user accounts that give the impression that you have an administrative role on swingby.se or otherwise represent yourself as someone or something that you are not. The user name you choose must also have a certain degree of decency and must not be deemed offensive by the Service.
Membership of the Service is basically free of charge. However, the Service may provide features and services that are only available to paying members at various levels. We reserve the right to include functions that are currently free of charge, either in whole or in part, among the functions that are only available to paying members.
It is okay to have an individual account (female or male) even if you also have a couples account with someone else. However, it is not allowed to have multiple user accounts of the same type. It is also not allowed to interact on Swing by as a couple with an account intended for an individual. If we discover that an individual account (female account or male account) is being used by more than one person, the account will be closed.
Swing by has the right to deny membership if we suspect that the user terms will not be followed. We also have the right to deactivate or block users who do not comply with the user terms and/or act harmful to the Service in various ways. In 'harmful behavior' is included unpleasant and rude behavior towards other subscribers on Swing by.
In the event of a breach of the user terms and deactivation of membership/user account, Swing by has no obligation to refund any remaining paid subscription days.
As a member, you always have the option to terminate your membership and delete your user account at any time. This is done by sending a request to terminate from the settings page for your user account. The user account will then be deleted by the admin within 24 hours and the account will be completely deleted and cannot be restored. Upon termination of membership/user account, any remaining paid subscription days linked to the user account will expire. However, Swing by has the right to block the user and retain the user account in order to complete ongoing investigations regarding the user.
You are fully aware and acknowledge that the use of the service is entirely at your own risk. Swing by only provides a service/tool to facilitate contact between people. We do not endorse any member on the website and you should be aware that contacts with other people on the website/app are at your own risk.
You are obligated to ensure that everything you publish on the website/app is information or material that follows applicable laws, terms of use, and copyright. You may not publish anything that you do not own the rights to. Nor may you advocate activities that violate Swedish law. Swing by reserves the right to delete anything that may violate the terms of use or laws, and also has the right to demand compensation for anything that can be attributed to Swing by in the form of damages and costs.
You accept that all information and material that you upload and/or share on Swing by will be stored by Swing by. We do not require any information that can be linked to your identity, except for the email address, which will not be published publicly but will only be used for communication between the member and the Service
As a member of Swing by, you are expected to act respectfully and kindly towards other subscribers on Swing by. Poor behavior towards others may result in deactivation from the Service, as it is perceived as harmful to the Service.
If you believe that a member is not behaving as they should and want to point it out, it should be reported to the Swing by administrators, who will take appropriate action according to our assessment.
All forms of advertising for services and/or products are prohibited on Swing by. Your user account on Swing by may NOT be used for commercial purposes.
It is strictly forbidden to take screenshots or otherwise save material and data from Swing by that is created by any other member for purposes other than error reporting.
Swing by takes no responsibility for any damages that may occur as a result of using the service. This applies regardless of the type of damage.
Swing by takes no responsibility for anything that happens outside of Swing by. Any external links published on Swing by are visited at your own risk. We also take no responsibility for any contacts with people outside of Swing by.
We only provide a platform through the web and as an application that enables contacts between individuals who use the service at their own risk. We DO NOT guarantee that the service will always be available without interruptions. Errors may occur as a result of technical mistakes and misfortunes. We undertake to operate and develop the service to the best of our ability, but we exclude responsibility for interruptions and errors that may arise as a result of causes beyond our control. We also reserve the right to take down the website for maintenance at any time. In general, however, maintenance will be announced on the website in good time before, but may also occur suddenly without warning.
The administrators of Swing by have the right to full access to all data regarding all users on the site in order to investigate criminal suspicions and ensure that nothing illegal occurs on Swing by.
Swing by is currently considered a beta version, which means that the service is under continuous development. This means that the likelihood of errors and interruptions in the service as a whole or parts of the service is higher than normal. Users of the service should be aware and have consideration that disruptions may occur sometimes.
The terms and conditions shall be interpreted and applied in accordance with Swedish law.
A dispute should be resolved through agreement in the first instance. If such agreement cannot be reached, the dispute shall be dealt with by a Swedish court. As a consumer, you can also turn to the municipal consumer advice for advice or refer the dispute to the General Complaints Board ('ARN'), in cases where ARN is competent. In the event of a dispute that is being examined by ARN, Swing by follows ARN's recommendations.
